verbal agreement

how do verbal contracts stand up in court, if you have witnesses to the verbal agreement.

My husband was business partners and we are now being sued for a loan which we did not sign but has been notarized. They are not partners any longer, he did not have a written agreement with his partner but does have several witnesses to the verbal contract between the two of them. Now the business is up for sale and we are being sued for thousands of dollars which he has came up with a contract ''signed'' by the both of us. where do we stand?

Depends on a lot of variables. If your question is: "Can a verbal contract be upheld by the Court?" the quick answer is "Yes."

As far as this "partner" coming up with a "signed contract," that is fraud, and there is a remedy for that. Strongly suggest you contact a trial attorney ASAP.
