Legal Question in Insurance Law in Indiana

beneficiaries

My grandmother died, leaving an insurance policy with

my sister as beneficiary, no contingent beneficiary named. My sister cannot be located. There is no

surviving spouse, no surviving children, just my sister and I as grandchildren. Is there any way I would be able to claim the insurance proceeds if my sister can never be located?

The insurance company told me that since my sister cannot be located, the proceeds would go into unclaimed funds. Is there any way I could claim these funds and how would I go about it?

Re: beneficiaries

You will be able to obtain the funds either as the

sole beneficiary of your sister's estate, or possibly

as a contingent beneficiary of your grandmother's

policy. Get a copy of the policy and show it to

an insurance agent who knows what he/she is doing,

or to a lawyer.

If your sister cannot be found, you can get appointed

as her guardian of the estate, and collect the funds

and hold them subject to further court order. At

least the funds will have to be paid, not held by

the insurer for its own benefit.
