Legal Question in Intellectual Property in Indiana

question about free midi and sheet music and guitar tabs

All over the internet I see midi renenditions of things like Final Fantasy music, and guitar tab renenditions of popular songs. These files are not the original version that one would purchase, but mere by-ear transcriptions made by individuals who just want to put their midi or tab on the internet. Is it illegal for me to download these files and use them for my own personal study and enjoyment?

Re: question about free midi and sheet music and guitar tabs

Probably No. The files you speak of are probably infringements of the original works by the original artists....if they are not infringements (I would need/hear to see the original works and what you are downloading to determine infringement), then you would still be infringing upon the people you are downloading from. Only if the material you are downloading is distinct enough from the original work not to be an infringement AND you have permission, are you safe. Whether you get caught is a different story. Sorry for the bad news, Justin

**there is something called "fair use" that allows limited use of another's work without permission, but (and without knowing more about your situation)you probably would not qualify for protection under that doctrine.
