Legal Question in Employment Law in Indiana

Change in FMLA consecutive 12 month requirement

If i worked for an employer previously for five years do i qualify for family leave if i got hired by that company again but i only had 11 consecutive months on the job? I heard this was something relatively new and if this is true I have been wrongfully terminated.

Re: Change in FMLA consecutive 12 month requirement

The requirement that you work for the employer for one year before being an eligible employee does not need to be consecutive. However, you still would have to meet the 1250 hour requirement in the previous twelve months. You should consult with an attorney to obtain more specific advice regarding your circumstances.
