Legal Question in Employment Law in Indiana

If my employer changes my hours to hours that I can not work due to childcare will I be entitled to Indiana unemployment? Currently I work 7:45-4:15 and they are changing it to 11-7:30pm.

If you are unable to work due to the change of hours, then you have a strong chance of qualifying for unemployment. There will be a factfinding inquiry to determine eligibility when you apply for unemployment compensation, because you were not terminated.

However, the employer has arbitrarily changed the terms of your employment. According to the department's employee handbook, an arbitrary change in conditions of your work is considered just cause for quitting voluntarily.

For more information about making an unemployment compensation claim, see the department's claimant handbook, here: http://www.in.gov/dwd/files/Claimant-Handbook_Jan-2010.pdf

Good luck!
