Legal Question in Medical Malpractice in Indiana

My son was taken to ER with abdominal extreme pain. I was suspicious of an appencitis, but it was ruled out to food poisening, even though I asked for a cat scan, they said it was not necessary. we went home at midnight, and at 430 am, we had major attack and had to go to same hospital by ambulance. I insisted on the cat scan, just to find out it was indeed an apendicitis. He had been in pain on the lower right part of his abdomin. His father and cousin both had these things happen in same way. we were told they do not run in families. I found out other wise. It wasn't until 430 pm next day when operation happened...He now had a perferated or leaking apendix. Do we have a case?
