Legal Question in Personal Injury in Indiana

Accident not my fault other party no insurance

I wanted to know what steps need to be taken to sue and individual that hit me in a car accident which the officer who wrote up the report indicated it was there fault for running a flashing red light.

I assume you've got insurance. If so, you need to make a claim under your uninsured motorist coverage. Also, notify your insurance agent about the accident immediately. If you delay too long, they could deny you coverage.

If the other party does not have insurance, you can make a claim under your own insurance policy. Most policies contain what is know as "uninsured motorist" coverage that provides converage for these types of situations. You should notify your insurance agent immediately and let him know that you were in an accident with an uninsured driver. The agent should know what to do from there.
