Legal Question in Personal Injury in Indiana

Got into an auto accident not my fault other driver caused accident my insurance expired 5 /31/2011.car is totaled front end gone motor in front seat all airbags deployed .can I seek out his insurance or get a lawyer to get compensation for said vehicle ?or without having insurance on my behalf iam automatically at fault. I live in indiana .

You are not automatically at fault and can certainly pursue a claim.

You can still pursue your claim and recover for the damage to your vehicle, but you are likely going to get a citation for driving without insurance which may result in your having your license suspended for a period of time (whether you pursue the claim or not.)
