Legal Question in Personal Injury in Indiana

Wreck

I wai hit by a drunk driver. I am going to try to settle myself. I just found out i need surgery on my shoulder to repair 2 tears, one being the rotator cuff. Myself and the other person have the same insurance company, but different adjusters. The other persons adjuster said they might be able to release ans advance on my lost wasges, prior to settling, but i need to sign a release so they can have access to my medical records. Should I sign ths form for them? I have already signed one for my adjuster. Also what is a fair settlement for this? I will be off 6-8 weeks. My car was brand new, and had almost 9,000. in damage. The other driver was arrest with a BAC of .21% Any other advice would be most appreciated. The injury is my dominate side also.

Re: Wreck

You need a lawyer. Your case has all kinds of problems with the same carrier on both sides plus the DUI may lead to a no coverage issue. Don't say anything. Don't sign anything. I worked for insurance companies for 14 years as their attorney and it is their job to make sure you get as little as possible no matter what your case is actually worth. You won't even begin to evaluate that until you have recovered. If you have questions call me at 219-340-3890. Indiana is one of the most pro-insurance states in the US. Insurance companies write the insurance laws here. If you get killed at work the award is $6,000. So you can see it is all in favor of them not you. I hold 4 doctorate degrees and practice in Indiana and California. The TV commercials make it sound like they are your friends. Trust me, they are not.
