Legal Question in Product Liability in Indiana

I had a metal shaving in my milkshake on 3/23/11. It stuck into my tongue. Do I have a case? The company is Steak N' Shake. I still have the piece. I've spoken to the district manager. He wanted to take the piece of metal but I held onto it.
