Legal Question in Real Estate Law in Indiana

Egg hatchery

Neighbors built a 25,000 egg hatchery less than a quarter of a mile from my home. The egg hatchery will have been in production one year this August. It smells so bad at times that we have to go indoors. I know there is the Freedom to Farm act. I also read that I have a constitutional right to own property ''includes the right to use and enjoy it.'' Do I have any rights to not have to smell the stinch from this farm or am I just screwed? I don't care if they want to use their farm to have eggs I just don't want to smell it! Thank you.

Re: Egg hatchery

You and your other neighbors should try contacting the Indiana Department of Environemental Protection as a first step. Your second step is to gather the other people in the area who are effected and contact an attorney in South Bend or Fort Wayne who has environmental experience.
