Legal to sell a home with known black mold? Also, buying a home or contract, for six months, and then the company finances you, if you move before the six months on the RTO stage, can they turn that into a repo on your credit?? I am thinking about small claims to try and get my down payment returned, have 20 pics of the mold, black mold an inch thick, there is still mold under the carpet, couldnt use the room for two months, I just asked for the down payment , and they wont budge.

It IS legal to sell a home with black mold, but the seller may be liable to the buyer for the problem if it is a builder (and you are the first or second-time buyer of that new home) or if the seller knew about the black mold (or underlying problem causing it) and knowingly concealed the problem from you.
