I am in the process of purchasing a single family home in Indiana in 2010. House is listed as a 3 bedroom but none of the bedrooms have windows that meet escape standards (ie. They are more than 44 inches from the ground) All bedrooms are on main level and do not have any exterior doors. Is this safety code violation enforceable in the sale of the house? In other words can I ask the seller to replace one window in each room to meet the egress standards or would this code violation be one that is grandfathered in? I read the code and it states that most items of existing houses are grandfathered in unless a rehab is performed or unless it deals with a code violation that affects safety or health. I have not found any specific documentation on what constitutes a safety violation, but in my opinion these windows would be a safety violation. Any help or reference to code that mentions whether these windows would fall under an "unsafe" violation would be appreciated.
