property damage by neighbor's horses

My neighbor's horses were running loose several times in the past and damaged the lawn around my house. The left deep marks, ripped off the grass entirely in some spots, and left their excrements too. The neighbor's fence was/is not in good shape or the gate to the stable was left open. Every time I saw the horses out I called my neighbor and I made records of the incidents. I told him that I don't want to tolerate this anymore, he never came over to look at the damage or to offer repair, and I'm thinking of sueing him for the damage his horses did. The lawn is in really bad shape, the ground is uneven, and I'm afraid that my kids may be injured (maybe twist an ankle) when playing ball or something. What do you think?
