Legal Question in Real Estate Law in Indiana

Subdivision

I live in a subdivision in Indiana which has a short list of restrictive covenants such as keeping yard mowed etc. but how are they enforced? We have neighbors with high weeds and junk cars which are against the covenants but we have no idea on how to enforce them.

All I can find at the courthouse are the discription of the Subdivision, Certificate of deed and who filed it in 1971. One old neighbor told me that someone used to enforce them but over the years it has fallen by the wayside.

Re: Subdivision

I'm sorry you have such an obnoxious neighbor. Any property owner within the subdivision can enforce the restrictive covenant by filing a lawsuit against the offending party. If you had a neighborhood association, that would be a better plaintiff, since it would be less personal. And the city attorney's office might do something if you ask. Good luck.
