Legal Question in Sexual Harassment in Indiana

Sexual Harassment?

In Feb of 2005, I was hired as a network engineer for an international vending company. Soon there after I began a sexual relationship with at the time my supervisors boss. She is married, with 2 kids and has been caught cheating on her husband before, I am single. After being promoted several times and eventually becoming a direct subordinate of hers, I asked to end the affair and soon there after my employment was terminated after she told the president about some legal problems I was having. There are several emails, witnesses and travel logs that validate this claim.

I have since them sent them a confidential settlement letter, of which the contents I would rather not disclose publicly, however, the idea was to give them an opportunity to save face and settle before a claim was filed with the EEOC and eventually a lawsuit.

My questions?

1. Is this sexual harassment?

2. The company did not respond to my settlement letter, rather ignored it, what steps do I take next?

3. I read the fed gov. limits sexual harassment claims to $50k for companies with under 50 employees, is this information correct?

I have some other questions also, but just looking for some guidance on where to go from here.

Re: Sexual Harassment?

From the facts that you described, there may be a claim for sexual harassment and there also may be a retaliation claim. The Federal limits that you mention refer to the maximum punitive damage, but the cap does not apply to your wage loss or attorney's fees. You should contact an attorney to have all of your questions answered and develop a strategy going forward. I can be reached at [email protected], if you would like to speak with me further.
