Legal Question in Traffic Law in Indiana

Is there a way to appeal a judgement reguarding a traffic accident?

I was involved in a car incident in which neither car was damaged at all. Police were not called, she stated she had no time. Having no insurance she proceeded to sue me. Through circumstances not of my own doing I never received the correct court date. I failed to appear and a judgement of 3000.00 was ordered against me. I have witnesses and I would have won the case. My question to you-is there an avenue available to have this case retried since I was not present, is there a time limit on such a case?

When was this judgment entered and in what court. If the case is a District Court case you have only a short time to appeal to Circuit Court (jury trial). You must do so immediately if you have not already done so and you can appeal for any reason whatsoever. If you are in Circuit Court you should apply to have the default removed. However, in any event, you will probably need an attorney to help you with this matter. Do you not have insurance to help you defend this case?

Give me a call if I am in your area, and I'd be happy to discuss the matter with you.
