Legal Question in Traffic Law in Indiana

Hi LawGuru,

I got a highway speeding ticket that says I was doing 83 in 70 zone. I always use my cruise control at 75mph. My court date is June 10th. Do you advise me to plead 'not guilty' & have a trial? What are my chances? The ticket is $125...court fees are $120.

Appreciate your prompt response!

Best,

Vivek

Unfortunately 75 mile per hour in a 70 mile an hour zone is still not prohibited. While many of us have come to expect that a few miles over the limit is an acceptable range, here the officer believes your were 13 miles over the posted limit. Only you or your lawyer can decide if you have a valid defense after a careful review of all the facts and circumstances. Good luck.
