Legal Question in Wills and Trusts in Indiana

Beneficiary/Inheritance

Can my mother and father change their will so my husband receives none of their inheritance? They are leaving all the money to me, but as long as we're married, how can this legally happen? Our son is listed in the will, but how can a spouse be excluded?

Re: Beneficiary/Inheritance

As you may know, parents are sometimes disappointed with their children. So, your husband's parents have every right to name whom they want to be the beneficiaries of their estate. They do not need to name their son, your husband. If they die and leave your husband's portion to you, they probably intend that you will look after it better than he would. Who knows? You should know as much about that as anyone. But their reasons are not legally important, so long as they are mentally competent and not under any undue influence. Good luck.
