Legal Question in Wills and Trusts in Indiana

Executor for an estate in another state.

My father recently passed away in Indiana and i live in Arizona. What do I need to do to have my Uncle act on my behalf for my fathers estate and not give up all rights to the estate.

The answer depends on the value of your father's estate. If it's small enough, you can do this with an affidavit. If not, then you need to open a probate in the Probate Court. You can read more about these issues at the Maricopa County Superior Court website.

You do not have to appoint your uncle or anyone to protect your rights and interest in the estate of your father. The probate court in Indiana will protect the interests of all of the heirs. If you have concerns, you could retain an attorney in Indiana, located where the probate of the estate is to take place. You could retain an attorney here, who would represent you and work with the attorney representing the estate and whoever is appointed to act as the executor/personal representative of the estate.
