husband dies without a will

my husband died a year ago last march ,had no will and i was his third wife. he had 4 kids by his first wife. he had real estate in florida and indiana, they have sold everything in indiana, all that is left is in florida. how much would i be intitled to besides the kids, and how long should it take to settle the estate? they sold everything in indiana in dec. 2006, and put the realestate in florida up for sale in feb. 2007. i want rid of this mess but , also get what i should. everything was only in his name.

You should confer with a local attorney as soon as possible. If your husband had no will or trust, and if the property was not owned jointly with his children, then I don't see how they had authority to sell the property without opening a probate estate. You would be entitled to claim a twenty-five thousand dollar spousal allowance plus fifty percent of the remaining value of the estate. Good luck.
