Legal Question in Wills and Trusts in Indiana

My mother passed in 1999. My step-father moved in with me. He passed in 2004. I was his power of attorney & & executor of his will. He spent the last year of his life in a nursing home. He had less than $1000 in the bank when he passed. That money was spent on funeral expenses. I have recently found he & my mother have unclaimed money from the state of WV. Because the total of both equals more than $5000, they told me I had to open an estate in IN, where he passed. I had an accountant tell me this only needed to be an bank account in his name. Is this true? Or do I where do I need to go to open an estate? Can I do this without the assistance of an attorney?

You probably need to post this in the West vVirginia forum since it is that state agency who is requiring an open estate.
