Legal Question in Wills and Trusts in Indiana

shares without niminations

my father who suddenly passed away held certain amount shares which he didnt have a chance to nominate. I only wish have these specific shares tranfered to my mothers name. Dont wish anyother assets to be included in this as rest all is nominated correctly to my mothers name. I have a brother and sister and would much prefer we dont split assets now. How best could i go about this transfer.

I do not think you can do anything without first opening an estate. Then I know that your desire not to have all the assets included is not going to fly as they will need to be included in the estate. If there is a Will, the Will determines the split. No Will, then the intestacy statute determines the split by shares. This is a good example of why people need estate planning.
