suit against the estate

Can someone file a suit over an IC 32-15-7 issue against an estate without first filing a claim against the estate? I am refering to IC 29-1-14-2.

So long as you have named the personal representative as a defendant I believe you can get away without filing the claim timely. However, if there is time to get the claim filed, I would recommend that it be done promptly.
