Valid Will?

Had a will drawn up in Indiana, is it still valid in North Carolina or does it need to be redone?

As long as it was properly executed pursuant to Indiana law, North Carolina should recognize it upon your demise.

Many times a will drafted in another state will remain valid in North Carolina. If there were two or more witnesses, it may very well be valid here. However, most attorneys are willing to review such a will to ensure that there are no problems with it for either nominal or no charge. If you plan to remain in North Carolina, I would strongly recommend that you consider having a new will drafted by an attorney in NC. It may also be a good time to review related planning documents, such as a Health Care Power of Attorney, Living Will, and if you are in poor health or a senior, a Durable Power of Attorney. These other planning documents are usually heavily variant according to state laws and therefore should be drawn by an attorney in North Carolina since businesses and health care providers are much more likely to recognize documents from the state in which you live.
