Legal Question in Wills and Trusts in Indiana

Will Interpetation

Our church was left money from an estate. The will was first written in 1954, however the last heir just passed away. The trust left our church money with the language as follows... the principle is to be used on a new church structure or structures of the church.

The problem is a new church is not an option- mainly because of the cost- but also because of the historical nature of our building. Our real need is a new parsonage for the pastor and his family. My feeling is that the plural ''church structures'' would include any structure owned by our church including the parsonage.

We have an attorney that has discussed that we should file a ''Si Prae''? sp? motion in court for an interpetation. Is this a common procedure what would you suggest?
