Legal Question in Bankruptcy in Iowa

Bankrupcy: Student Loans

If student loans are put into a bankrupcy, can the state garnish your wages 7 years later. The student loans were less then $5,0000.00 at the time. My attorney included these loans in a bankrupcy that was filled in 1996. The loans were from 1993-1995. I have documentation from the state of Iowa that sais, my loans were included the bankrupcy. However, the Attorney General sais I'm wrong and is garnishing my wages.

There is a distinction between listing a debt in a bankruptcy, and getting a discharge as to that debt, first"ALL DEBTS" must be listed, but the law excepts certain types of debts from the general discharge, taxes, child support, ect, and in your case unless an "adversary" was filed student loans are not covered by the general discharge given by the judge, check with your filing attorney or I can check for you 309 788-2747 Bruce
