Legal Question in Education Law in Iowa

Private Property & Our Rights

Our son (15yrs.) was approched by the local police one evening that we were not home. He had cigeretts on his possesion and the police took them. We were never notified nor did the police fine him. However the policeman went to our sons school and told them. He is now unable to participate in sports. Is this legal & ethical?

Re: Private Property & Our Rights

Legal...depends on your state laws. For example, here in California, if a child is caught with cigarettes at school, going to or coming from school or at or going to/coming from a school function, the school can take disciplinary action against the student. You don't mention where your son was approached. Also, you should ask for copies of your school district's policies on these matters. Some school district's have their atheletes sign "contracts" promising not to drink or smoke...in these contracts the consequences for breaking the promise is spelled out. If the student understood and agreed, then they're kind of stuck with the consequences.
