Legal Question in Family Law in Iowa

Court ordered Child Support paid in 1996 but, Iowa continues to follow collectio

Girlfriend got a divorce in Iowa under Common Law Statutes while I was still legally married to another woman. Child support was included in divorce decree. I fell behind and later moved to Kansas. Iowa filed petition in Kansas Court for $14,000 back child support and current child support. The Kansas Court ruled I owed $7,000 in back child support and current child support. I paid according to the Kansas Court order plus I sent additional money and the State of Kansas took 1/2 of my retirement check to add to my Child Support obligation. In 1996 I contacted the Kansas Court and asked how much more I owed because I wanted to pay the child support off. I received nothing in writing from Kansas but they returned 6 of the checks they took from my retirement. That indicated, I had fulfilled my obligation which the Kansas County Attorney's Office later confirmed for me. I didn't hear anything else until January 2001. I received an invoice from the State of Iowa saying I owed $13,000 in back child support. They say they based the invoice on the 1972 Iowa Court ruling. I had a lawyer contact them and they responded they didn't know anything about me. I had another lawyer contact them but they did not respond to him at all.

It sounds to me like you have to deal with the child support recovery unit in Iowa. It also sounds like you didn't get the kind of resolution you need from your attorney. I suggest you get another one and push the issue through to a conclusion. However, sitting on the issue since 2001 will only accrue interest on the unpaid amount, if that is what you owe.
