Legal Question in Family Law in Iowa

divorce modification

When I was divorced 11 yrs ago I was not working so the decree states that my ex can claim the children on taxes. The last 7 years we have split the children, he gets one and I get the other. I have worked consistantly for the last 7 years. Well this year he has informed me that he is claiming both. It needs to be modified so that we can each claim one. Is there any form I can get so I can do this on my own? I can not afford an attorney and I think with the legal background I have I am able to do this myself but am having a hard time finding any info on this subject. Could you tell me if there is a form or sample form that I can use?

Thank you,

Brenda

Re: divorce modification

You will need to petition the court to modify the decree....as it says he gets to claim both you will have to come up with a good reason why the court should change it. I do not recommend self help, unless you are interested in getting clobbered....look at it as an investment. You also have not said who has the primary custody of the children.
