my ex husband has solo physical custody of our 3 children. I have open visitation. he now wants to return them to me. do we need to go to court for this or can we just inform the courts?

Unless you want him to come around and take them when he pleases you'll get the custody and support order amended, and that means going to court and doing it all nice and legal.
