Legal Question in Medical Leave in Iowa

Will FMLA be feasible for me, need knee surgery and am out of sick leave?

I need knee surgery soon, however I am out of sick leave and vacation due to medical problems the last few months. Does this make me eligible for FMLA or don't I need it? I will be without a paycheck during the 6-8 week recovery period.

FMLA and surgery

Depending on how much of your 12 week bank you have used up already, by being out, you may or may not have an adequate amount.....see a local employment attorney for your state's rules and statutes on the interplay between disability law, insurance benefits, and the FMLA.....it varies state to state.
