Legal Question in Civil Litigation in Iowa

My husband was called into perform duties for the business that he works for. He was driving my car and while performing these duties a deer landed in the middle of the hood of the car. Is the company legally responsible to replace my car? They turned my deductible into their insurance and that is all that they feel they are responsible for. I tried to explain that if he had broken his arm they would not turn it into Blue Cross they would turn it into workmans comp. I don't feel that we should be left holding the bag on the expenses incurred. What should I do? They won't even speak to me about it because they say if they do something then they are setting a prescedent.

If your insurance company is involved you have already subrogated your interest in the case. I would contact them and see what they have to say about the matter.
