a city clerk related false information to a job applicant about my 12 year-old daughter during a job interview. the clerk took it upon herself to warn the woman that there where charges and an investigation by the police towards my daughter. the truth is a past friend of my daughters accused her of touching her private area and threatening her. the accusation was investigated and was unfounded and was right after an confrontation between the two girls so most probably it was considered revengeful. i can't do anything about the false report but can i file civil charges against the city clerk for slandersous statements on a 12 year-old child. also would that include the city as part of that action?

I never give firm advise unless I have met the person seeking legal help. In general you have a problem proving what was said. You have hearsay. What is the listener willing to say the Clerk said to her? Do you have it in writing? Did the listner write it down right after it was said to her? What are your daughters damages? How firmly established is the reputation of a thirteen year old? Your best bet is to meet with the City Attorney, advise him of what was said and demand assurances the clerk will be reprimanded and this will not happen again or legal action will be sought.
