Legal Question in Landlord & Tenant Law in Iowa

My stepson and ex-girlfriend bought a mobile home on contract last february. The relationship ended in November and my stepson moved out. The property was given back to the owner. Both my stepson and his girlfriend signed the promissary note. The landlord is suing only my stepson and not the girlfriend for the damages to property plus what was owed on the property. Can she due this in small claims court or should both parties be listed on the paperwork.

The landlord is entitled to sue one, or both. If she sues your son his remedy is to sue the girlfriend for contribution. It is called joint and several liability.
