Legal Question in Medical Malpractice in Iowa

knee replacement surgery

3 years ago this December I had total knee replacement on my left knee. The night of surgery I saw that my left foot was turned significantly in. I asked the nurse why and the nurse said it was muscle. I addressed this on several visits to my surgeon and he wouldnt tell me what was wrong. I have gone to 4 different doctors asking what is wrong with my foot and to no avail. I have trouble walking, I fall down, and now I have been told I will have to wear a brace indefinatly and that I have nerve damage that was caused by the Dr hitting a nerve while doing surgery. I did have one Doctor tell me that my replacement is loose but still would not address my foot issue. After almost 3 years not only does my foot turn in, I am walking on the side of my foot. I am unable to take a walk around the block without pain in my knee. This has been going on since the day of surgery. Do I have any kind of legal action that I can take because of the damage to my knee?

Your description makes it difficult to give you an answer with any assurance. What state was the surgery? Why did you wait three years to seek legal advice? Your case may no longer be viable due to the statute of limitations. You need to immediately seek legal advice by making an appointment with an attorney from the state where the surgery was performed. A most recent case is not favorable towards a patient waiting this long after the surgery to act legally. You should not post any further publicly and immediately seek legal advice in person.

I agree with Mr. Lombardi. In every state there are time limits in which to bring cases. They are called statutes of limitation. If you do not bring a case within that time period you cannot bring a case. You need to contact a medical malpractice attorney immediately in the state in which the alleged malpractice occurred to discuss your rights. Good luck.
