Tax question/marriage

If I marry a man who has some back tax issues, once we are married, do they become my problem also?

Re: Tax question/marriage

No. The liability would be solely that of your spouse.

Now, if you file a joint tax return with IRS-owing (future) spouse, and have a refund due, the IRS will retain the whole refund. The IRS will apply it to your spouse's back tax liability and will continue to do so until it is paid in full.

Similarly, if you and your (future) spouse jointly own property, the IRS could file a federal tax lien on that property in order to protect the debt owed to it by your future spouse.

Re: Tax question/marriage

You will not owe the taxes. However, there are some problems. For example, if you have a joint bank account, the IRS will levy it. If you buy a home together, any lien against him will attach to it. If he attempts an Offer in Compromise to settle his debt, the IRS will look at the income you bring into the household to determine his ability to pay. My best advice is for him to take care of the problem as soon as posible. I can help you if you have any questions. Steve Klitzner 18002191118
