Legal Question in Consumer Law in Italy

Did not receive product paid for

I was to purchase a snowboard set through a guy in Italy. We agreed for me to pay half, he would send the set and when I received to set I would pay the remainder of the balance. I sent the money through Western Union and he picked it up within an hour. Now he will not respond to any of my emails. It'd been 2 days. I found out that it was on E-Bay auction and there was a winner and I contacted the winner and told him the story. He also tried to contact the seller to make payment and the seller will not respond to him either. I am out the $35 for the first half of the payment and $15 Western Union charge. I know its not alot but I would like to either guy my money returned or get the items that he was supposed to send.

Thank You for your time,

Jason

Re: Did not receive product paid for

Dear Jason:

In examining this response, please note that we are not entering into an attorney/client relationship, that this is to be taken as informative, and not as legal advice, that it is always best to speak to a lawyer in your area and/or in the area where the transaction and/or events occurred, and that my answer is necessarily limited by the fact that I have not seen the documentation or had an opportunity to go over the matters with you in detail.

It sure sounds like you've been had. File a police report (bring your documents) and look online for the "Crime Victims Compensation" (the last word is either "Fund" or "Board") for New York State. In some cases, they will make a victim whole.

Good luck.

As I mentioned before, this is something that you may want to take up with a lawyer of your own selection, either in your state or area or in a place where some of the pertinent events occurred.
