Legal Question in Bankruptcy in Kansas

My sisters spouse was recently admitted into an assisted living facility due to illness. It is uncertain if he will ever be healthy enough to return home. They own a home (not sure whose name it is in) and have some other accounts as well. They are not rich and are unable sustain the cost of this care for long. There is concern that the care facility will take possession of their home and other holdings to cover this expense. My sister is extremely concerned for her own wellbeing. What legal protection is afforded to all parties involved? What should be done, if anything, to protect her assets?

Very sorry to hear about your brother-in-law's health issues. You posted this under the category of bankruptcy. But, that may not be their best option at this early stage of his housing and treatment. They, or at leasst your sister, should consult direclty with an estate planning attorney in their area. That attorney can get much more factual information thatn you have room to list here. The attorney can then advise them as to their options to avoid liquidation of their assets.

Good luck
