Legal Question in Business Law in Kansas

Please Advise

We had a case (Neglegent Death) with an attorney against an nursing home/hosp/Dr's.. in which my mother died.The case had been pending since 2004, in 2010 our attorney dropped the ball. I believe her caseload was to heavy, because of many mistakes she made we ended up in the Federal Court of appeals, we had to appeal because she didnt send the certified letters in time ??? We loss the appeal, and afterwards she told us it was her faught and that we could either go to the supreme court or we could sue her, she said thats what she has insurance for and she was prepared at that time to give us her insurance information, we did not take it at that time because we did not know the decision of the appeal at that time, I dont believe its been a year yet, is it possible for us to file a malpractice suit against her?
