Legal Question in Civil Rights Law in Kansas

Hello,

My husband and I are having issues with a neighbor over a fence that is legally on our property. We had a surveyor come out and draw lines. They are upset because they used our property for years before we moved in and now they feel they are entitled to a shared driveway. They have been harassing us, called the cops on us and are now filing a lawsuit against us. I'm 6 months pregnant and my husband is a fisherman risking his life for our family. This is causing me so much stress, that I'm worried about my well being and my unborn child's life. Can I file a lawsuit for emotional distress?

There are few things that cannot be the basis for a suit. But, some aren't worth the expense. Unless you have medical records demonstrating the emotional/psychological damage, it probably isn't worth initiating a suit. But, since they steady already suing you, you might be able to bring yours as a counterclaim, and save some money. Dieses discuss this with the attorney representing you in that suit.
