Legal Question in Credit and Debt Law in Kansas

Signed a rental lease with a friend; on a move-in special recently. Friend was to pay our rent and didn�t; an eviction notice has been served. In meantime; friend was arrested and is in custody and may be for in jail for a while. I am unemployed, have no vehicle and I have had to move to my parent�s home in another town. Set to go to a bench trial next week. Since lease in both our names, are we each responsible for half of the lease balance that they are wanting money for? Since unemployed, I cannot afford an attorney.

Unless the lease says otherwise, you are each liable for all the rent. That is, if the landlord gets a jydgment, they can seek to collect it all from either of you. If you wind up paying more than half, you can go after the roommate for their share. However, if you file a cross claim, you may be able to have the roommate reimburse you for any that you pay. That is if you can prove the arrangement you mentioned where they agreed to pay all the rent. Perhaps your parents will help you hire an attorney.
