Legal Question in Criminal Law in Kansas

My wife babysits for a few friends and friends of those friends. She spanked one of the children after having used other disciplines. The parents have filed charges for child abuse and are seeking legal action through SRS for an "ilegal daycare". She began babysitting for friends who couldn't find a babysitter, and we have never considered it a "daycare". She is not a licensed daycare and has informed each parent of that fact up front before babysitting. What is our legal right in this matter? Is there any legal definition of what is considered a "day care"? Should we have any concerns about this matter?

Should we seek legal council if this is escilated to the court room?

There are regulations propounded by the state of kansas that sets forth what a daycare is.

Further, if criminal charges or a civil case is filed against you, you must consult an attorney for legal advise.

You should consult an attorney anyway to make sure your wife is in compliance with Kansas law regarding her business.

The only way you can get qualified legal adivse in this matter is to sit down with an attorney and give him much more specific facts about you situation.
