Legal Question in DUI Law in Kansas

I was arrested for a DUI in October 2009, and got a second in February 2010. I have not gone to court to start diversion or probation for either yet but my license has been suspended since November. Will either DUI show on my record yet? And with two pending charges are you allowed to move out of state?

With a DUI, you are facing two problems: the criminal charges for DUI, and the administrative action regarding suspension of license. The arrest will appear on your criminal record shortly after arrest; however the DUI will not appear on your criminal record unless and until you are convicted. As to your license, you MUST timely request an administrative hearing or your license will be suspended.

As to moving out of state, you may not be able to obtain a license or employment out of state while a DUI is pending. Therefore, I urge you to reconcile this matter prior to moving. Feel free to contact me if I you want to discuss this matter.
