my daughter got an m.i.p. in Kansas. she is 20. will the charges stay on her record forever or will they drop off when she turns 21? we are trying to decide whether to pay for a diversion or not.

In almost every cae, it is adviseable to obtain a plea, where a defense to the charge woudl not likely be fruitful. The record of the charge will stay with her for a while. They can be used to determine whether to accept a plea in afuture charge for up to 7 years. Employers will be able to fidn the conviction for the rest of her life. (in the digital age, almost nothing stays hidden). As you may know, a diversion means that the charges will show as dismissed when she completes the diverions period. But, it can be more costly in the short term. You, your daughter and her attorney will have to weigh the options.
