Legal Question in DUI Law in Kansas

My son received an MIP in Kansas. He had not been drinking and passed the sobriety test. He was not given a breathalizer. Should he plead guilty of not guilty? Should he speak with the city prosecutor and request a dismissal and if he doesn't agree to that request a diversion? This is his first offense and he'll be 21 before his court date.
