Legal Question in Entertainment Law in Kansas

My question is regarding electronic devices in casinos in Kansas and may possibly need representation. From my research on Kansas statutes, I cannot find anything that shows it's illegal to use an electronic game that does not affect the outcome of the game, however, assists you in calculating odds. A couple of examples of devices are the Casey Computer for blackjack or a roulette computer. One of the few things I found is this from K.A.R. 112-108-5:

"(d) A facility manager shall not allow a patron to possess any calculator, computer, or other electronic, electrical, or mechanical device at any table game that meets any of the following conditions:

(1) Assists in projecting the outcome of a game;

(2) keeps track of cards that have been dealt;

(3) keeps track of changing probabilities; or

(4) keeps track of playing strategies being utilized, except as permitted by the commission."

From what I gather, this pertains to casino employees and understand that using such a device can get you banned at the establishment, however, would a patron of the casino using a device like that be conducting a crime?

Teh issue for you is "except as permitted by teh commission" It may be that the commission has permited mangers to ban the very devices you mentioned. Look to see what the commission says in their publications and statements.
