Legal Question in Family Law in Kansas

abused by the child protective services

I have a question that involves the state taking my daughter from me because of juvinal charges against me. When I was 14 I was falsely charged and adjudicated of a sexual charge. just 2 years ago i recieved a affidavid from the ''victim'' stating that I never touched them. Now the cps has taken my 4 year old daughter after from my mother after it was found out that my step father had raped her this happen while I was in the middle of court against my mother trying to get my daughter from her so now the cps says that because I was ''Convicted'' of a sexual charge while I was a child that I cant have my daughter until I complete another round of sexoffender classes. If I dont then they are going to adopt her out this is realy tearing up my wife which is the said childs mother. Is this right and what can I do?

Re: abused by the child protective services

Under the facts you have described, your wife has not been accused of any crime or neglect ragarding yrou daughter. Therefore, it appears that there is not grounds to involuntarily "adopt out" her daughter. Seh probably has nothing to wory about, but should request appointed counsel (or hire her own) if the situation with the daughet goew before a judge. As to the requirement that you undergo sexual predator treatment, there are not enough facts provided for me to give you specific advice on that.
