Legal Question in Family Law in Kansas

Changing original divorce agreements

My ex and I originally agreed to share joint and physical custody (50/50 in homes etc.) We also agreed to split finances 50/50 and alternate the dependency status from year to year. Soon after we formally agreed to this, my ex decided to quit her full-time job and spend more time with our son. Although we never formally agreed on this (with a contract), I did provide more financial support for our son's medical and daycare/schooling. This suport has fluctuated over time depending on my income. My ex has never recieved any money from me. This has been our informal arrangement for ~7 years. I now want my ex to start paying for her half of our son's expenses. She has threatened to take me to court to change our agreement so that she would get child support. What are the legal rights for the parents in this scenario.

Re: Changing original divorce agreements

From your description it appears that circumstances have changed and either party should be able to seek changes with regard to the orders. It's a little complex to speculate exactly how your situation would be resolved without reading the documents and determining how much you or the spouse owe on amounts owed due to the previous court orders. Your current income, her current income, child care, health care expenses all need to be taken into consideration. Recommend that you see an attorney and negotiate an amendment to the decree.
