Legal Question in Family Law in Kansas

Divorce Truck Loan Obligations

I was recently divorced in Sept. 2002. My ex was awarded the truck. He currently drives around with expired tags, no insurance, and repeatedly makes late payments(if any pymts and rights bad checks on the loan). The bank informs me that I am responsible for the activity on the loan because I was the primary on the note. All of this negative activity is going on my credit history. What do I do??

Re: Divorce Truck Loan Obligations

Sorry you've found the really negative part of the domestic court's jurisdiction. . .in a divorce case, the court has no power over 3rd party creditors if one of the parties to the action fails to comply w/the court order. The best you can do is notify the 3 credit reporting agencies of the reason for the late payments. . .contact your attorney to file a motion to 'show cause' why your ex should not be found in contempt of court. . .the best scenario, which is often less available, is to negotiate w/the financial agency to pay off the note.
